This Sample Marriage
Contract is based on the 1662 Solemnization of Matrimony,
from the Book
of Common Prayer. The Founding Fathers of this Republic (who could
never have imagined
a time when a couple needed the state's permission to marry)
would have understood
this document. Contracts having the essential elements of this
Sample Contract
have been used in all 50 states by couples who have not
obtained a state-issued
Marriage License.
An ordained or
state-approved minister is not required.
A Marriage Contract
DEARLY beloved, this document records that we were gathered together on this the 6th day of July, in the year of our Lord 2005, here in the sight of God, and in the face of this congregation, to join together Adam Ha'Aretz and Eva Costal in holy Matrimony; which is an honorable estate, instituted of God in the time of man's innocency, signifying unto us the mystical union that is betwixt Christ and his Church; which holy estate Christ adorned and beautified with his presence, and first miracle that he wrought, in Cana of Galilee; and is commended of Saint Paul to be honorable among all men: and therefore is not by any to be enterprised, nor taken in hand, unadvisedly, lightly, or wantonly, to satisfy men's carnal lusts and appetites, like brute beasts that have no understanding; but reverently, discreetly, advisedly, soberly, and in the fear of God; duly considering the causes for which Matrimony was ordained.
First, It was ordained for the procreation of children, to be brought up in the fear and nurture of the Lord, and to the praise of His holy Name.
Secondly, It was ordained for a remedy against sin, and to avoid fornication; that such persons as have not the gift of continency might marry, and keep themselves undefiled members of Christ's body.
Thirdly, It was ordained for the mutual society, help, and comfort, that the one ought to have of the other, both in prosperity and adversity. Into which holy estate these two persons present came to be joined.
Declarations of Adam Ha'Aretz and Eva Costal
This agreement is a privileged contractual communication protected by the Bill of Rights and Article 1, Section 10, Paragraph 1, Clause 8 of the Constitution for the united States and shall not be governed by and construed in accordance with the laws of any of the states.
I, Adam Ha'Aretz, knowing no reason why I may not lawfully marry, shall take Eva Costal to be my wife. I shall love you, comfort you, honor and protect you, and, forsaking all others, be faithful to you as long as we both shall live.
I, Adam, take you, Eva, to be my wife, to have and to hold from this day forward; for better, for worse, for richer, for poorer, in sickness and in health, to love and to cherish, till death us do part, according to God's holy law; In the presence of God I make this vow.
Eva, I give you this ring as a sign of our marriage. With my body I honor you, all that I am I give to you, and all that I have I share with you, within the love of God, Father, Son, and Holy Spirit.
Eva, I give you twenty United States dollars in specie, along with other good and valuable consideration, as a sign of my commitment to support you.

Prayer and Proclamation
God our Father, from the beginning you have blessed creation with abundant life. Pour out your blessings upon Adam and Eva, that they may be joined in mutual love and companionship, in holiness and commitment to each other. We ask this through our Lord Jesus Christ your Son, who is alive and reigns with You, in the unity of the Holy Spirit, one God, now and for ever. Amen.
On this the 6th day of July, in the year of our Lord 2005, in the presence of God, and before this congregation, with no one present having given a reason why they may not lawfully marry, Eva Costal and Adam Ha'Aretz have given their consent and made their marriage vows to each other. They have declared their marriage by the joining of hands, by the giving and receiving of rings, and by the exchanging of at least twenty United States dollars in specie, along with other good and valuable consideration. I therefore proclaim that they are husband and wife.
